The Supreme Court judged that if the vehicle did not move because of a breakdown, it could not be punished for drunk driving.



The third division of the Supreme Court said it had confirmed a court case plea for acquittal in the appeal of Mr. A, who was accused of drunk driving.



In 2016, Mr. A has been tried on charges of starting a vehicle that stopped in an accident while drunk and operating a transmission.



The judge ruled that "it is difficult to say that a criminal act was committed just by stepping on the accelerator pedal, in light of the fact that the danger of drunken driving becomes a reality when the car is actually moving while driving."
