Under the Criminal Procedure Act, a defendant can apply for a transfer of jurisdiction when there is a concern that it is difficult for the competent court to maintain the fairness of the trial.
Previously, Mr. Jeon, who was sentenced to two years probation after eight months in prison at the first trial held at the Gwangju District Court, filed several applications for transfer to the court but was dismissed.
