Reviving the fire of the Seoraksan cable car business


The embers of the Seoraksan Osaek cable car installation project, which had been virtually eliminated, have been revived after a year and three months.

It is the National Rights Commission that revives the fire that was extinguished after controversy over the destruction of goat habitat.

The Seoraksan Osaek Cable Car Project plans to carry tourists by connecting a 3.5km Gondola from the Osaek Mineral Spring in Yangyang-gun, Gangwon-do to the Dancheong section.




On the 29th, the Central Administrative Appeals Committee, a member of the National Rights Commission of Korea, cited a request to cancel the disposition of the environmental impact assessment of the Seoraksan Osaek Cable Car against the Ministry of Environment by Yangyang-gun, Gangwon-do.

Instead of the Ministry of Environment, which put the brakes on the business, Yangyang-gun gave the hand.

There are three reasons for the citation decision as stated by the Central Administrative Appeals Committee.

First, the project in this case was approved by the National Parks Commission to change the national park plan through procedures such as installation and operation guidelines for natural parks, and received a natural environment impact assessment. Even though there was a review, it was contrary to the purpose of the relevant regulations that the notification of this case was made on the premise that the appropriateness of the plan corresponding to the strategic impact assessment review criteria and the location of the project were inappropriate He explained that despite the fact that it was possible to give additional supplementary opportunities for flora, etc., the indefinite thing was taken into account the injustice.



As usual, nine members, including the chairperson, attended the deliberation on the administrative trial case.

The chairperson was the vice chairman of the Rights Committee, and 3 standing members and 5 non-standing members were together.

The decision was not unanimous, but by a vote.



However, there are some things that are unclear.

First, it is a project that has been approved by the National Parks Committee.

As pointed out by the committee, on August 28, 2015, during the Park Geun-hye administration, the National Parks Committee approved the change of park plan requested by Yangyang-gun.

Yangyang-gun submitted a draft environmental impact assessment report to the Wonju Regional Environmental Office on December 24, 2015.

The Ministry of Environment requested for supplementation on February 2, 2016 after review by specialized organizations such as the Environmental Policy Evaluation Institute (KEI).

Five months later, on July 26, Yangyang-gun submitted the original proposal, and the Ministry of Environment demanded that it be revised in November.



What the Central Administrative Appeals Committee pointed out as unfair is that the Ministry of Environment made an unwavering decision without a second request for supplementary supplementation to the original evaluation report.

At that time, both the draft and the original document of Yangyang-gun's environmental impact assessment were engulfed in controversy over insolvency investigations, and received negative evaluations from specialized agencies.

On May 16, 2019, two years and six months after receiving the request for supplementation, Yangyang-gun resubmitted the environmental impact assessment report to the Wonju Regional Environmental Office, revealing its intention to promote the project.

However, the controversy over writing poor evaluation did not subside.

Wonju Regional Environmental Office discussed major issues through the Environmental Impact Conflict Mediation Council.

Twelve outside committee members attended, and opinions were divided into 4 undisputed, 4 inadequate, and 4 contingent agreements.

Eventually, the disposition was imposed.




When the Central Administrative Appeals Committee decides to cite it, the administrative agency must follow it.

It is impossible to disagree through administrative litigation.

However, if the claimant is dismissed, it can be judged by the court again through an administrative lawsuit.

On the other hand, Yangyang-gun announced that it would proceed with the follow-up procedure as soon as a new consent or conditional consent from the Ministry of Environment comes out.



Four licenses remain for the Seoraksan cable car business.

There are three things related to the Korea Forest Service: the permission to develop the Baekdu-daegan, the temporary use of the mountain, and the national forest use.

The remaining one, the permission to implement the park project, must be obtained from the National Park Service.



Yangyang-gun expects to be able to open the first shovel in about 22 years if the licensing process is smoothly completed for the next year.

The construction period is set to two years, and when completed, it is said that 1 million tourists are expected to arrive annually, resulting in a profit of 14.5 billion won.

The cable car project will be operated jointly with the National Park Service.
