A nursing assistant who was deceived as a fluid for relieving fatigue and put an anesthetic to kill his boyfriend has been sentenced to 30 years in prison.



The first part of the Supreme Court (Chief Chief Justice Ki-taek Lee) announced on the 26th that it has confirmed the court case sentenced to 30 years in prison in the appeal of A, a nursing assistant accused of murder, etc.



In October 2018, Mr. A was tried for killing his boyfriend B (30 years old at the time of death) by administering an anesthetic with Ringer at a motel in Bucheon, Gyeonggi-do.



He is also accused of stealing medicines and taking propofol to Mr. B without a prescription.



It was investigated that Mr. A suspected that Mr. B was sexually traded based on the account details of Mr. B from which the money was withdrawn.



It turned out that Mr. A deceived him as a fluid to relieve fatigue and administered an anesthetic over lethal dose to Mr. B.



At the time of the incident, it was found that Mr. A was also taking the drug, but the concentration was at a treatable level.



Mr. A denied the allegations of murder, saying that he and his boyfriend made extreme choices during the trial.



The police reported that Mr. A tricked Mr. B into administering more than a lethal dose and injecting only drugs below the therapeutic concentration, and sent the case to the prosecution on suspicion of hierarchical consent or murder.



The crime of hierarchical concession and murder is applied when a person is killed with the consent of the other party after deceiving as if they would make an extreme choice together.



However, the prosecution handed Mr. A to trial for murder, saying there was no evidence to believe that Mr. A and Mr. B tried to make extreme choices at the same time.



The first trial admitted to Mr. A's murder and sentenced him to 30 years in prison.



Mr. A appealed, but the second trial dismissed it, and the Supreme Court did not accept Mr. A's appeal.
