According to the legal profession, Minister Chu will soon form and convene a disciplinary committee for prosecutors and enter into disciplinary proceedings against Yun.



The Prosecutor's Discipline Act requires the Minister of Justice to request disciplinary action against the Prosecutor General.



In addition, the Minister of Justice can order a disciplinary suspect to suspend his or her duties.



This is the reason that Minister Chu ordered the suspension of his duties after requesting disciplinary action against President Yoon on the 24th.



The disciplinary committee consists of seven members, including the Minister of Justice, the chairman.



Excluding Minister Chu, the remaining six members are composed of the Vice Minister of Justice, two prosecutors appointed by the Minister of Justice, and one attorney, a professor of law, and one person with knowledge and expertise appointed by the Minister of Justice.



Except for the Vice Minister of Justice, the composition of all members is determined by the Minister of Justice.



As such, the Minister of Justice's influence on the prosecutors' disciplinary committee was so great that the National Assembly passed the National Assembly amendment in September to increase the number of disciplinary members to 9 and to consist of 3 persons recommended from outside.



However, the revised provisions will take effect on January 21 of next year and do not apply to this disciplinary committee composition.



As there is currently no prosecutor's disciplinary committee, it is known that Minister Chu must appoint and appoint all members.



Since the disciplinary committee includes three outside personnel, it is expected that the due date for disciplinary hearing will be set within the next week at the earliest, considering the appointment schedule.



If necessary, Minister Chu may order President Yun to attend, and the disciplinary committee may interrogate any necessary matters.



However, since Minister Chu is a disciplinary claimant, he cannot participate in the case deliberation.



In addition, during the resolution process, President Yoon may request a disciplinary claim against Minister Chu.



The disciplinary committee deliberates on the case and decides on disciplinary action with a majority vote of the members.
