Mr. B's lawyer said, "The defendant feels great guilty and apologizes for the victim and his family members." But the critical moment (related to the accident) is not in the accused's memory."



He added, "It is a position that legally a very close review is necessary to see if it can become an accomplice of the Yoon Chang-ho Act," he said.



On September 9 this year, Mr. A was arrested for killing C (54, male), who was drunk on a road near Eulwangri Beach in Jung-gu, Incheon on September 9 this year, driving a Mercedes car, and then riding a motorcycle to deliver chicken. .



At the time, the Mercedes vehicle that Mr. A drove invaded the center line, and his blood alcohol concentration was 0.194%, far exceeding the license cancellation level (0.08%).



Before the accident, Mr. B was accused of virtually driving under the influence, such as opening the door of a Mercedes vehicle owned by his company with a remote controller so that Mr. A could ride in the driver's seat.



The prosecution judged that Mr. B was not simply a supportive of Mr. A's drunk driving, but actively encouraged him, and applied the so-called'Yoon Chang-ho Act' to both.



The Yoon Chang-ho Act combines the revised Special Deals Act, which reinforces punishment for deaths from drunk driving, and the revised Road Traffic Act, which reinforces standards for suspension and cancellation of driver's licenses.



Mr. B was the first to prosecute a passenger in a drunk driving vehicle by applying the Yoon Chang-ho Act.
