The Court of Destruction of Seongnam Mayor Eun Soo-mi, who was convicted of violating the Political Fund Act, was sentenced to invalidate the election, and was revived by the Supreme Court's ruling to destroy the court below.



As a result, the silver mayor was freed from the crisis of invalidating the election by maintaining a fine of 900,000 won by the first trial.



The second part of the Criminal Division of the Suwon High Court ruled today (16th) that the appeals of both the prosecutors and the mayor of Eun were dismissed at a hearing sentence for remand of the case.



The court followed the Supreme Court ruling, saying, "When looking at the prosecutor's letter of appeal and the reason for appeal, it was written as'unfair sentencing', but it did not specify the specific reason. This cannot be said to be a legitimate reason for appeal."



In addition, he explained, "Regarding the reason for the defendant's appeal, the Supreme Court has already revealed that the defendant's argument is not reasonably conclusive, and it is impossible to make a judgment contrary to this."



As the court dismissed the appeals of both sides, the fine of 900,000 won sentenced by the first trial was maintained.



If an elected official is sentenced to a fine of 1 million won or more for violating the Political Fund Act, the election is invalid.



From June 2016 to May 2017, Mayor Eun was handed over to trial on charges of receiving vehicle convenience 95 times from the coma trade headed by Mr. Lee Mo, a former gangster in Seongnam for his political activities.



The first trial sentenced a fine of 900,000 won, but the second trial significantly increased the sentence and sentenced to a fine of 3 million won, equivalent to invalidating the election.



The Supreme Court, however, rejected the court case in July, claiming that it violates Article 155 of the Criminal Procedure Rule for the prosecution to simply write down the reason for the appeal as'illegal sentencing' and fail to provide specific details in the appeal process, and returned the case to the Suwon Plaintiff Act.
