About this time two years ago, Yoon Chang-ho, who went on vacation while serving in the military, was hit by a drunk driving vehicle and died in a month and a half.

The Yoon Chang-ho Act, which strengthened punishment for drunk driving due to public resentment, came into effect in December of the same year, and it is a content that can be sentenced to life imprisonment if a person dies while driving while drinking.

So, is there a severe punishment for this purpose?

Reporter Park Jae-hyun reported on what was the case of the drunk driving fatal accident in Geumcheon-gu, Seoul in April.

On the evening of April 29, a road in Geumcheon-gu, Seoul.

A man heads at a pedestrian crossing to cross the street.

The van rushes to you, then passes by the man crossing the crosswalk.

This man, who was leaving work, had to cross this road to get home.

An accident occurred at the pedestrian crossing, and the shock pushed the man to a distance of 5 meters.

Driver A, who got out of the wince, grabs the fallen man and starts shaking.

The victim's upper body is lifted and dropped, causing the head to hit the ground.

Lesser witnesses get out of the car, call 911 and begin CPR.

The man was taken to the hospital, but eventually died.

As a result of the investigation, it was revealed that driver A had an accident while running close to 4km while drunk with a blood alcohol concentration of 0.143%.

[Victor's wife: I said that the groom came early in the morning and went out.

I made them come early and my granddaughters and granddaughters really liked it.]

Soju bottles came out inside the car.

The perpetrator was arrested and handed over to trial, but the bereaved's suffering continued.

First, the trial schedule was not properly informed to the survivors.

[Son of victim: (I learned this trial) You can think of it as about a week.

At that time, it was open on my own, but why didn't I contact you?

But I don't receive (call from the prosecutor's office) all day.] When

I filed a petition to the court asking for severe punishment for the perpetrator of Buryaburya, this time it was wrongly listed as a reference material given by the driver through the court computer network.

The perpetrator also tricked his job as a security guard at trial.

[Son of victim: (at trial) I'm a security guard.

It’s so different because you’re a security guard.

How did this guy's job change?

Gangbuk Apartment Security Guard The person who died so unfortunately was when the issue was in full swing.]

I went to the place where the perpetrator worked.

[Acquaintance of the perpetrator driver: Sometimes (to the company) faces to shine, and it just goes away.

I can't talk or talk...

.]

[Neighbor of the offending driver: No, the security guard.

There is no such thing as a guard here.] Even

more amazing facts were revealed.

The offender had a history of drunk driving in 2002 and 2007 and even received probation.

There were many unfavorable circumstances, such as the perpetrator only subscribed to liability insurance and no agreement was reached, but the court sentenced the perpetrator to four years in jail, which is one-third of the old amount for "reflecting, old, and having a grade 5 spine disorder."

[Son of the victim: The prosecutor was sentenced for 12 years, so I believed and waited for it, and the sentence was tried, but it was 4 years.

I did a lot of reflection, but no, I shouldn't do it to the judge.]

Although the sentence was greatly strengthened after the implementation of the Yoon Chang-ho Act, there are many cases where a cotton bat is only punished.

From July this year, out of the six alcohol death judgments that have been searched for by the Supreme Court, only one sentence was imprisoned and the rest were probated for reasons such as "reflected and agreed."

[Jung Kyung-il / Traffic Lawyer: It is a bit unconvincing that the sentence was sentenced to four years at the bottom, not at the middle point (of the new Supreme Court sentencing criteria).

The reality is that people are still being sentenced to a dangerous driving manslaughter, the Yoon Chang-ho law, which does not affect the people's legal feelings and victims.]

Four days later, two years after Yoon Chang-ho's accident, a drunk driver who kills an innocent life. The purpose of the Yoon Chang-ho Act to punish severely is becoming unclear.
