A court ruling has ruled that severe punishment against a teacher who puts a cell phone under the skirt of a middle school girl's school uniform is justified for condemning a student.


Teacher A put a mobile phone under the skirt of student B in the library at the middle school where he worked in May 2018.

When the phone screen was turned into the skirt, another student stopped him, and Mr. A left the library saying it was a joke.

Six months later, Ms. B's guardian raised the issue at an interview with the principal.

In February of last year, the Gwangju City Office of Education punished Mr. A for three months for suspension, and filed a lawsuit stating that Mr. A cannot accept it.

It is claimed for educational purposes to teach that wearing an excessively short skirt in public places can result in harm.

In addition, the phone screen was turned off at the time, and the prosecution also confronted that the disciplinary action of the Office of Education was unfair.

The second division of the Gwangju District Court dismissed Mr. A's claim in a lawsuit for canceling the disciplinary action filed by teacher A against the Gwangju City Superintendent.

The judge said, "As a homeroom teacher, Mr. A, who is responsible for protecting and guiding students, has a high possibility of social criticism for acting as if shining through a student skirt with a mobile phone."

“It was not intended to be sexual harassment and it was argued that it was for educational purposes, but it is difficult to admit, and even if it was for educational purposes, it is difficult to see that behavior performed without any explanation to Ms. B is normal.”
