The court has put a brake on an administrative order that bans large-scale gatherings in the city center on Liberation Day issued by the Seoul Metropolitan Government for concerns about the spread of Corona 19.

The 11th administrative division of the Seoul Administrative Court (Deputy Judge Hyung-soon Park) interrogated the temporary suspension of execution that the'April 15 Unfair Election National Struggle Headquarters' (hereinafter referred to as the National Investment) filed for notification of the ban on outdoor assembly in Seoul on the afternoon of the 14th. And accepted.

According to this decision, the National Investment Fund can hold a rally scheduled for tomorrow (15th).

The judiciary said, "The place, method, number of meetings, and quarantine regulations that must be obliged to be observed are not specifically permitted, but the disposition of this case, which essentially prohibits the holding of the assembly itself, will dispel concerns about infection. It is not very likely to be considered illegal as it is difficult to see as limiting the freedom of assembly within the minimum range necessary for this." I decided.

The judge said that even though a large-scale rally has been held in the center of Seoul recently, the fact that no corona19 confirmed cases have occurred at the rally should be considered in the future rally permission.

In addition, the National Investment Bank has prepared and managed quarantine measures at the recently held assembly, and it is not justified to ban the holding of the assembly itself as it is expected to comply with quarantine measures except for some deviators.

Earlier, the National Investment Board claimed that the election for the 21st National Assembly members held in April this year was a fraudulent election, and on the afternoon of Liberation Day, it announced that it would hold a rally and march in the vicinity of the Euljiro entrance area, Jung-gu, Seoul, asking for the truth.

The Seoul Metropolitan Government asked organizations, including the national investment, to voluntarily cancel the rally reported on Liberation Day, saying, "I am concerned about the spread of Corona 19 through a large-scale rally," but when it did not comply, it issued an administrative order prohibiting the assembly.

There are a total of 26 organizations reporting the Liberation Day assembly as announced by the Seoul Metropolitan Government, and a total of 220,000 participants reported.

Accordingly, the National Investment Fund said in the provisional disposition application filed with the court, "The Seoul city's political and arbitrary disposition using Corona 19 (prohibition of assembly) fundamentally violated the freedom of assembly and association." Has argued that there is no reasonable reason to ban assembly in circumstances that allow it.”

Min Kyung-wook, a former member of the Future Integration Party, who is the standing representative of the group, also expressed his intention to hold the event as scheduled.

Conservative groups such as the Free Solidarity and the Republic of Korea, including the National Investment Fund, also expressed their intention to enforce the Liberation Day rally as scheduled.

However, the Republic of Korea later changed the meeting place in front of the Seoul Detention Center in Uiwang, Gyeonggi-do, where former President Park Geun-hye is imprisoned in Gwanghwamun.

The KCTU also decided to hold a rally in downtown Seoul in disobedience to the Seoul Metropolitan Government's administrative order to ban assembly.
