"The confiscation of the vehicle as an object of fact is a discretionary decision of the court," says Kai Wantzen of the Hanseatic Higher Regional Court. Especially in the case was that the retracted motorcycle technical changes were made, which were not allowed. "If the journey had been completed with an inconspicuous family carriage, the use of which the driver's family urgently needs, the court would probably have decided differently in terms of proportionality," says Wantzen.

The accused initially appealed against the punitive order, but withdrew it, so that the decision is now final. The 160 hp and about 15,000 euros expensive motorcycle is auctioned.
