"The Administration of Justice and the State, in general, cannot allow him to be released while she is locked up," added the lawyer, who considers that the purpose of the preventive measure adopted by the investigating judge less than a year ago month "maintains" and that there is "a high flight risk".

The former Barça player has been in jail since January 20 by order of the head of the Investigating Court number 15 of Barcelona, ​​who estimated that the risk of the Brazilian footballer fleeing is high, due to the financial resources available to him and because there are no extradition agreements between his native country and Spain.

The judge also considered then that there is sufficient evidence to confirm the version of the victim, a 23-year-old girl who reported to the Mossos d'Esquadra that Alves had raped her in the private bathroom of a private room at the Sutton nightclub in Barcelona in the night of December 30.

Alves' defense, exercised by the lawyer Cristóbal Martell, presented an appeal on January 31 in which he requested the provisional release of the soccer player, who in exchange offered to hand over his passport, wear a telematic bracelet, pay the necessary bail or appear , even daily, in court.

The appeal ruled out the risk of flight, arguing that Alves no longer has the "economic muscle" he had after being fired from his last club, the Mexican Pumas, and having been suspended several advertising contracts with different brands.

Ester García, the complainant's lawyer, used in her opposition to the appeal the defendant's high economic capacity and attached documentation relating to fifteen Brazilian companies linked to the footballer, in addition to the companies he manages in Spain.

The lawyer also stressed that the investigation of the case is being "agile and without any delay", without the circumstances that led to his imprisonment having changed in any way.

At the appeal hearing held in the third section of the Provincial Court, Alves was not present, who has been an inmate in the Brians 2 prison in Sant Esteve Sesrovires (Barcelona) since January 23, when he was transferred from Brians 1, where they were admitted. the majority of preventive prisoners, to "better guarantee safety and coexistence".

In the session, which was held behind closed doors to protect the privacy of the victim, Alves' defense once again questioned the complainant's version, among other things, because she did not present vaginal lesions.

The lawyer has also argued that the internal images of the Sutton nightclub show that there was consent to sexual relations on the part of the young woman, since she voluntarily entered the bathroom.

According to Martell, in addition, the former FC Barcelona player has sufficient roots in Spain and has justified it with documentation such as the purchase and sale of a home in Esplugues de Llobregat, a historical certificate of registration and documents from companies owned by him.

In reference to the recordings of the cameras of the nightclub, the private prosecution has pointed out that, when leaving the premises, the player is seen seeing the victim crying and without addressing her.
