• Reform Congress strengthens protection for victims of traffic accidents

  • Report Road Safety suspends cars, drivers and roads

Weeks ago, the Congress approved to reinforce the protection of the victims of traffic accidents with the approval of an amendment of PSOE and Podemos, the two great parties of the Executive.

But making good that of one of lime and another of sand,

these victims now denounce that the negligence of the same Executive is supposing them to stop losing a lot of money from their compensation.

Up to

90 million euros per year, which is what the insurers themselves estimate that they could be saving

due to the delay in modifying the technical bases of the scale, which will mean an increase in the amounts received by the injured and their families.

Adaptation to the new SMI

In a letter sent by the associations ANAVAR-RC (lawyers), ADEVI and ADAVIAC to the Minister of Economic Affairs and Digital Transformation, Nadia Calviño, they remind her that this delay

especially affects the heavily injured "whose economic needs have been exponentially increased.

Because the tables pending modification are precisely those that set the life annuity that corresponds to them, the help of a third person or the health expenses that they will need in the future based on the years of life that the injured person has left.

The key to the matter is that these tables are linked to the Interprofessional Minimum Wage (SMI)

which is

50% higher than when they were made

.

It has gone from 600 euros per month to 1,000.

To introduce this change and also adapt the changes in pensions, the Executive warned that it would need to delay the implementation of the rule, approved at the end of 2021, for six months.

But the date of July 1 has arrived and it is still not in force .

45 million left uncollected since January

"Since January 1, 2022,

this has meant

savings

to insurance companies of

about 45 million and every month of delay another 75 million

that are being stopped by those injured with serious consequences," says Manuel Castellanos, president of ANAVA-RC.

In addition, from the same association they remember that "the updating of the technical bases should have been carried

out 3 years after the publication of the 2015 Law and it was not done.

Later they assured that they would take place after 5 years at the most and they have passed 6 and they have not been updated either. After July 1 of this year,

but here we are still waiting"

As if this were not enough, the victims denounce that

the different improvements to the Scale

that the Committee of Experts prepared more than a year ago and that include up to

50 measures

on which the victims and the insurance sector agree have not been implemented either.
