The Administrative Court of Sports (TAD) has ruled this Wednesday in favor of LaLiga after filing the request of the examining judge of the Royal Spanish Football Federation (RFEF) in relation to Deportivo-Fuenlabrada on July 20, which proposed the reduction of Madrid residents for their trip to La Coruña.

In the resolution, to which Europa Press has had access, it states that "the competence to know the facts consisting of the actions of CF Fuenlabrada in its displacement to La Coruña -according to the return to competition protocol of May 15, 2020 - corresponds to the National Professional Football League ", and not to the RFEF, reads the letter.

Therefore, Fuenlabrada will continue to play in the SmartBank League, the Spanish Second Division, because the protocol established -as a consequence of the Covid-19 pandemic- before resuming the competition "constitutes the special rule compared to the general rules typified in Articles 68 and 74 of the RFEF Disciplinary Code ".

"The conflict of powers raised must be resolved in favor of LaLiga, as it is competent under article 69 of its Bylaws to exercise disciplinary power with respect to alleged breaches of agreements validly adopted by its internal bodies," adds the CAS .

Against said resolution, which is "final administratively", it is possible that an appeal may be filed within a period of two months, and the RFEF will only be able to archive the case. Deportivo de la Coruña, which had requested the relegation of Fuenlabrada for "putting public health at risk", could still resort to ordinary justice.

This decision of the TAD comes a few hours before the meeting that LaLiga and the RFEF will hold this Thursday, with the Superior Sports Council (CSD) as a mediator to find a solution to the number of teams that will make up the competition and the calendar draw. After this resolution it is ratified that they will be 22 in the Second Division and Fuenlabrada will be among them.
