• Will Facebook and Instagram apps shut down soon in Europe to protest "privacy law"?

In any case, this is the assertion that has been circulating on Twitter for a few days.

, the Meta company explains that this is not a threat from Mark Zuckerberg, but only an uncertainty for the company expressed by its leader.

  • Data protection laws have evolved in Europe and are now stricter than US regulations.

“Mark Zuckerberg is threatening to shut down Facebook and Instagram in Europe so they don't have to comply with privacy laws.

“For a few days and the publication of a tweet from the Mediavenir account that has gone viral on Twitter, several people have been worried or delighted – it depends – with the latest statements from the CEO of the Meta group.

But where does this claim come from, and is it reliable?

The Mediavenir account mentions “City AM” as the source of its information.

It is a free business newspaper distributed in the London area.

"Mark Zuckerberg and his team are considering shutting down Facebook and Instagram in Europe if Meta can't process Europeans' data on US servers," the newspaper's headline actually explained a few days ago.

But in its article, the British media makes no reference to a "threat" brandished by Mark Zuckerberg, but rather to the difficulty encountered by the Meta company in complying with the new European data protection regulations.

“We have no plans to withdraw from Europe”

“We have absolutely no desire or plans to withdraw from Europe, but the simple reality is that Meta, and many other companies, organizations and services, rely on data transfers between the European Union and United States to operate global services, ”says Meta France to

Previously, the transfer of data between the two continents was regulated by the Privacy Shield.

Faced with numerous criticisms of this agreement, the legal framework was amended in July 2020 and the text replaced by Standard Contractual Clauses (SCC), which create stricter rules for the transfer of data.

For many international companies like Meta, this new regulation makes it more difficult to store European user data on US servers.

The end of activities for Meta?

“Companies need clear global rules to protect long-term transatlantic data flows, pleads Meta France to

Between the United States and Europe, discussions are therefore underway to structure the new legal framework for personal data.

Developments that could have concrete consequences for Meta's activities in Europe.

In its last annual report submitted to the Securities and Exchange Commission (SEC) – the US federal financial market regulator – Meta said: “If we are unable to transfer data between and among the countries and regions in which we operate, or if we are restricted in sharing data between our products and services, this may affect our ability to provide our services, the manner in which we provide our services, or our ability to target advertisements, which could negatively impact our financial results.
