Mali: magistrates refer the end of the Transition to the Constitutional Court

The Magistrates' Union Reference (Refsyma) and the Malian Association of Prosecutors and Prosecutors (AMPP), two professional and activist organizations, members of the opposition coalition Appel du 20 February, filed a request with the Court on Thursday March 28 Malian constitutional law.

While the transition period opened with the military coup of August 2020 officially ended on Tuesday March 26, the Malian transitional authorities are still in office. Refsyma and AMPP therefore ask the Constitutional Court to take a position to recognize that “

the current authorities are without mandate or power to represent

Mali

” and to “open “

a new Transition

” “

including all the components of the Nation , including the Republican army

. Its main mission: the organization of elections for the return to constitutional order. 

In the request they filed, the magistrates and prosecutors represented by these two organizations invoke in particular “

the requirement of the preservation of democratic achievements

” and also ask for “

the cessation of attacks on public freedoms

”.

Cheick Mohamed Cherif Koné, who chairs both organizations, was dismissed from his position as chief lawyer at the Supreme Court of Mali two and a half years ago, then removed from the judiciary last summer. The transitional authorities did not appreciate his statements on the exploitation, in his eyes, of Malian justice.

This referral to the Constitutional Court is in line with the

demands expressed in recent days

by a large number of Malian political parties, of all tendencies. 

However, it has very little chance of succeeding: the authorities in place, who have not even considered it useful to communicate about the official end of the transition period, do not seem in any way ready to give up power.
