The Audience of Barcelona will judge from this week on Enrique TA, a 51-year-old neighbor of Barcelona, accused of the crimes of inducing suicide and attempted fraud, for which the Prosecutor's Office claims five and a half years in prison and a fine of 1,800 euros. According to the prosecutor's brief, the defendant entered into a friendly relationship with another neighbor in the same 27-year-old city in 2010 "having almost daily contact, both in person and through telephone conversations" or through telephone applications. The Public Ministry points out that the accused is "a very self-confident, independent and self-centered person with a tendency to perfectionism, control and obstinacy" and that his friend was "a dark person on the emotional, emotionally unstable, dependent plane, with lack of assertiveness, with an important emotional need focused on their intention to achieve a stable partner. "

Thus the two strengthened their relationship to such an extent that in April 2013 the defendant convinced his friend to sign a life insurance policy in his favor with a capital of 499,000 euros being the defendant who appeared as beneficiary in case of death of the victim. The prosecutor notes that the policy included a clause for death by suicide in which it was stated that during the first year the insured capital would not be collected but after this period could be obtained.

To sign the insurance, the defendant explained to the company that he was going to establish a partnership with three partners contributing the capital, so he wanted to be sure that if any of his partners "anything happened, he could recover the money." However, the prosecutor notes that between April 2013 and June 2014, when the victim was found dead "there is no record that the accused had constituted any company."

"Since December 2013, the defendant, in development of the plan he had set out, aimed at decanting the state of concern" of his friend towards "a depressive state," according to the prosecutor, knowing "the decisive influence he had" On his will. So I sent messages like "you're depressed," "when you go through everything is that you're depressed," "don't get depressed, you're always the same," and the like. Even the victim shaved his control when the defendant said by message "I am watching you, yes you went to bed late."

The Prosecutor's Office notes that at the beginning of March 2014, the victim began a courtship with another person and that he told the defendant the details, who, when the expiration of the first year of the policy was close, "began to intensify" his questions and reproaches about This sentimental relationship. In this context, he told his friend that "I have to tell you something, but it will hurt, he was not partying, he is not interested in you and he will hurt you a lot, cut with him or you will suffer, he doesn't love you, he looks at the league and goes very strong, and I have evidence. "

For this reason, the prosecutor believes that since April 2014 he was accused "knowing the decisive influence he had on the will" of the victim, who was also concerned about the university exams in order to pass the subjects as well as for economic reasons, "he continued with his plan to decant the state of concern" from the friend to a "depressive state". In May 2014, the victim asked him if he had sleeping pills and the defendant told him that he was giving him because "I have so many that I don't know what to do with them." The Public Ministry points out that as a consequence of the "psychological siege" the victim had the idea of taking his own life and so he told his friend repeatedly between the end of May and the beginning of June in messages such as "I already have a suicide date, after the exam tomorrow ... nobody wants to be with me "or" noiet, I am writing to say goodbye, tomorrow he will go to the cove of the dead and I have decided to kill myself ".

"At no time did the defendant contact" his friend with "a specialist doctor or contact his relatives after the successive manifestations of his intention to take his life" and at no time tried to dissuade him, but rather "to On the contrary, he reinforced the resolution "of the victim to suicide" decisively influencing "his thoughts on" his own death ", the prosecutor considers. The Mossos d'Esquadra found the victim's body on June 14, 2014 in a family home in Barcelona after his disappearance had been reported. He committed suicide by taking medication and alcohol.

Five days later, the defendant referred this death to the insurance company. The family of the victim was not aware of the life insurance policy until August of that same year, through information from the General Directorate of Registries and Notaries and which contained the process as beneficiary. The Prosecutor's Office considers that he committed this crime of inducing suicide and a scam to the company. In addition to the prison sentence, he asks that the victim's parents be compensated with 250,000 euros. The trial will begin this Monday at the Audience of Barcelona.
