The City of Montpellier will file a complaint against Nicole Belloubet for "illegal taking of interest" in its decision to set up a new administrative court of appeal in Toulouse rather than in the capital of Hérault, announced its mayor Philippe Saurel this Saturday.

“Nicole Belloubet lied about the money, the timetable and the decision. We discovered that the design office responsible for evaluating the Montpellier and Toulouse sites is located in Blagnac. Its main client is the Toulouse metropolitan area, said Philippe Saurel at a press conference.

Denouncing the minister's family and political connections with Toulouse, he intends to file a complaint, on behalf of the City, with the Court of Justice of the Republic, competent to judge the ministers for acts committed in the context of their functions.

The choice of location discussed

"We sense the existence of a conflict of interest in this decision in connection with the electoral interests of Nicole Belloubet" and La République en Marche "with the City of Toulouse. However, a minister has no right to intervene in matters in which he has interests, ”added Me Gilles Gauer, the municipality's lawyer. Nicole Belloubet was assistant to the town hall of Toulouse.

The various left mayor of Montpellier, support of President Emmanuel Macron, also questioned the calendar, stressing that the unveiling of LREM investitures in municipal elections, such as in Toulouse where the outgoing mayor Jean-Luc Moudenc accepted it, had agreed with the choice of location. "This is suspect and goes against the general interest when we know that the volume handled by Montpellier is 10,000 to 12,000 cases per year against 6,000 in Toulouse".

The City of Montpellier also criticizes Nicole Belloubet for having justified his choice, in the press, for financial reasons in particular, by claiming that the Montpellier site required a greater investment (7.5 million euros) than that of Toulouse (5.3 million euros).

Inaccurate information communicated?

However, the agency responsible for the feasibility study announces on its website a cost of 8 to 8.5 million euros for Toulouse, which "means that it is likely that the Minister of Justice has given information inaccurate, ”said the lawyer.

Administrative cases handled in Montpellier are now subject to appeal in Marseille and those from Toulouse to Bordeaux. The new administrative court of appeal should allow them to be brought together. The final decision on its establishment must be the subject of a decree to the Council of State.
