January 24, 2020 The Antitrust Authority has initiated a non-compliance procedure against the social network Facebook. This was reported by a note from the Competition and Market Authority, explaining that Facebook did not implement what was prescribed in its provision of 29 November 2018. With this decision - the Antitrust recalls - the Authority "had ascertained the incorrectness of the commercial practice of Facebook of failure to adequately inform consumer users, when registering on the social network, of the collection and use for commercial purposes of the data they provide and, more generally, of the remunerative purposes underlying the service, vice versa emphasizing the gratuity. With the consequence of inducing the aforementioned users to make a commercial decision which, otherwise, they would not have taken ". For the Antitrust Authority "the decision was based on the assessment that the information assets consisting of the data of Facebook users, by reason of their profiling for commercial use and for marketing purposes, acquires an economic value suitable for configuring the existence of a consumption ratio, even in the absence of monetary consideration. Furthermore, the provision was confirmed on this point by the TAR ". In addition to sanctioning Facebook for 5 million euros, the Authority had prohibited the further dissemination of the practice "misleading and ordered that the company publish an amending declaration on the homepage of the company website for Italy, on the Facebook app and on the page personal of each registered Italian user ". Despite the removal of the claim 'it is free and will be forever' from the home page, the consumer who wishes to register on the social network however continues to not be informed by the company, with clarity and immediacy, as to the collection and use of their data for remuneration purposes. It also appears that Facebook has not published the amending declaration. The non-compliance procedure initiated may lead to the imposition of a pecuniary administrative sanction of up to € 5 million.
