"The ruling is to be considered void since the Milan Court of Appeal admitted to having forgotten 13 pages in the motivation filed on November 30th, against which it was not possible to appeal". This is one of the 'cardinal' reasons for the appeal to the Court of Cassation with which the defense of Laura Taroni, the former nurse of the Emergency Department of Saronno (Varese), requests the annulment of the sentence with which the second-degree judges confirmed the 30-year prison sentence for the woman.

The appeal was filed two days ago, upon expiry of the terms, by the lawyers Cataldo Intrieri and Monica Alberti who raised before the Supreme Court the question of the 13 missing pages of the reasons for the sentence. Issue for which the Milanese judges on December 23 last notified a measure by which a hearing was set for January 22 to proceed with the "correction" of what they considered "a material error" and therefore insert the sheets not printed which however have been attached to the convocation.

This procedure was called "unacceptable" by Laura Taroni's lawyers. "It is an unprecedented fact - said the lawyer Intrieri -. The code does not allow the correction of the material error in circumstances like these". In addition, he added, "if the Court changes the reason for the sentence, we will present another appeal" always in the Court of Cassation.

In some of the 13 pages missing in the grounds of the appeal judgment, as reported by the appeal of the lawyers Intrieri and Alberti, a fundamental question is addressed: the rejection of the request for a new psychiatric report which, according to the lawyers, "would have allowed evaluate the psychic condition of our patient ". The defenders of the former nurse, moreover, in their appeal, state that in the "second instance sentence there are logical errors in the motivation of the two murders accused" to the nurse in reference to "not having dissolved the doubts about his willingness to kill ".

Taroni is accused of killing mother and husband together with Cazzaniga, the doctor who, with others, is on trial in front of the Court of Busto Arsizio (Varese) also for the murder of the woman's father-in-law and 11 other Emergency Room patients who died , according to the accusatory hypothesis, following the administration without their knowledge of anesthetic drugs and sedatives.

For Taroni's defenders - it is reported in the appeal to the Court of Cassation - the pharmacological advice signed by the experts appointed by Leonardo Cazzaniga would have shown that "there is no certain correlation between the administration of drugs and death". The lawyers, always in the appeal, argue that Taroni for about two years administered to her husband medicines "to sleep and not force her to suffer unwanted sexual acts", but that whenever he had felt ill, "to have taken him immediately to hospital ".
