18 July 2017I pm in Milan Tiziana Siciliano and Sara Arduini have forwarded to the investigating judge, as ordered in recent days by the judge Luigi Gargiulo who ordered the forced indictment, the request for trial for help for suicide for Marco Cappato, l a member of the Radicals who, last February, Fabiano Antoniani, 40, a quadriplegic, known as Dj Fabo, voluntarily died in a clinic near Zurich.


In the request for dismissal, the magistrates had exonerated Cappato claiming that "the right to suicide belonged exclusively to the Antonians" because the "principle of human dignity imposes the attribution to Fabiano Antoniani, and consequently to all the individuals who are in the same conditions, a real 'right to suicide' ". And it was Dj Fabo, the Milanese prosecutors argued again in the request for dismissal rejected by the magistrate, the one who wanted to die: his desire to end it, "in addition to clearly emerging from all the public and private statements made by him and the unambiguous statements of all the people who were in contact with him, was ascertained by a doctor twice in the hours and days immediately before the suicide, according to the procedure prescribed by Swiss law ". Arguments not shared by the judge who ordered the forced indictment of Cappato. The preliminary hearing is still to be fixed. In case of indictment, the Radical risks ending up on trial before a Court of Assizes.

In the Italian legal system "there is no absolute right to suicide, let alone a right, payable by the State, to 'die with dignity', either by one's own hand or by the hands of others". The magistrate in Milan, Luigi Gargiulo, wrote this in the decree ordering prosecutors in Milan on July 10 to make a request for trial for suicide, sent today to the treasurer of the Luca Coscioni association , Marco Cappato, for the death of Dj Fabo.
