Five departments carry out joint rectification actions for the broadband access market in commercial buildings——

Break the building broadband monopoly

Broadband in commercial buildings is expensive, and enterprises and tenants chanted "Can't afford it"?

Property, developers and secondary operators cooperate to create monopolies, and broadband users have no choice whether to buy or not?

The facilities are old and the network speed is slow, and the theoretical bandwidth just "looks beautiful"?

In the future, these problems are expected to be completely resolved.

Recently, the Ministry of Industry and Information Technology and other five departments issued the "Notice on Carrying out the Joint Rectification Action for the Broadband Access Market of Commercial Buildings", which is expected to break the monopoly of broadband network business in commercial buildings and provide users with the benefit of speeding up and reducing fees. Kilometers".

Commercial buildings become broadband monopoly "hardest hit area"

Building broadband monopoly is an old problem.

"I wanted to install broadband at home last year. I went to the China Mobile business hall in front of my house and asked, but the other party said that the residential building in my community was not under their control." Wang Yang, a resident of Chaoyang District, Beijing, revealed that broadband in several communities near his home The business has already been "scribbled" by the agent operator, and which operator is responsible for the network of which cell is tacitly understood.

"I'm not afraid of poor service, or changing an operator. What I'm afraid of is that I don't even have the right to choose." Wang Yang said.

Compared with residential areas, office buildings are even more of a "hardest hit area" for broadband monopoly. Some agency operators have launched high-priced and low-speed "enterprise broadband" products, which has caused some small and micro enterprises to suffer.

It is understood that in the five years since the implementation of "speed increase and fee reduction" (increasing network speed and reducing network fees), relevant departments and local governments have repeatedly issued policies and carried out special actions to try to solve the local monopoly of broadband services in residential areas, office buildings, industrial parks and other places. The problem.

For example, the Ministry of Industry and Information Technology launched a one-year special rectification of commercial building broadband monopoly in December 2018, requiring basic telecommunications companies and others not to reach any form of exclusive agreement or agreement with real estate development companies, property management companies, etc., to ensure All enterprises have equal access and users have the right to freely choose.

However, the broadband monopoly problem in various places has not been cured.

"It is a common phenomenon for the three major operators to be unable to move the needles and splash water. This has led to a serious premium for office broadband fees. The extra part becomes the monopoly profit of property and agency operators." Song Chen and Zhang Xiaowei are universities. My classmates co-founded an education and training company after graduation, and rented an office in an office building in Beijing for more than a year.

The two introduced that small and micro enterprises, as lessees, have extremely limited voice and bargaining power in front of agency operators and property companies.

At that time, the agency operator of the property cooperation provided 100M bandwidth "enterprise broadband", and the cost was close to 15,000 yuan a year, which was much higher than the market price, but enterprises had no choice.

"Later, in order to reduce costs, in addition to renting classrooms for teaching, most of the company's business has now been changed to flexible office and home office." Song Chen said.

"Theoretically speaking, it is'guarantee equal access to more than 3 broadband operating companies.' In fact, several of the companies they find have a tacit agreement with no difference in pricing and essentially a monopoly." Zhang Xiaowei added.

Industry insiders pointed out that most of the residents in the community are the owners themselves, and they have a certain right to speak when dealing with the property, and the situation is better. Unlike commercial buildings, the companies that settle in are basically tenants, and the business is inseparable from the network. For the convenience of office, there is often more than one thing. It's better to do less", in front of the property, only "people are under the eaves and have to bow their heads".

Therefore, the monopoly of broadband networks in commercial buildings is generally more serious, and sometimes even property and secondary operators take threats to users and competing companies in order to maintain their monopoly status.

  Jointly rectify price violations

The network economy has become an important engine driving the high-quality development of China's economy.

In this context, China's fixed broadband access users continue to maintain a huge scale and rapid growth.

According to data released by the Ministry of Industry and Information Technology, as of the end of September 2020, the number of Internet broadband access ports in the country reached 937 million, a net increase of 21.04 million from the end of the previous year; China Mobile, China Unicom and China Telecom are three basic telecommunications companies The total number of fixed Internet broadband access users in China has reached 476 million, a net increase of 26.82 million over the end of the previous year.

At the same time, issues such as the monopoly of broadband networks in commercial buildings have been plagued by enterprises and users. They are an obstacle to the “last mile” of speed increase and fee reduction, and affect the sustainable and healthy development of the network economy.

Hunan guy Chang Jun runs a print shop on the first floor of an office building in Haidian District, Beijing. There are 3 computers in the shop for guests to use, but Caton’s internet speed often causes long lines in front of the computers, which affects the consumer experience.

"My broadband here is 200 megabytes bandwidth per year, and the actual use simply cannot reach the theoretical speed." Chang Jun said.

A person in charge of a broadband operating company that specializes in broadband access services for office buildings and universities revealed to reporters that the reasons for the formation of local broadband monopolies are complicated: some developers have not implemented strict standards when building buildings and have not laid fiber optic cables in place. Handed over to the operator to charge an "entrance fee"; some properties lack the corresponding funds to carry out the necessary renovation and upgrade of the building, designate a specific operator to renovate the facilities and charge an "entrance fee".

"Secondary operators are more flexible than large operators in terms of negotiation and pricing. After entering the venue, operators who have already paid a sum of money can only raise their prices further in order to ensure profits." The person in charge said.

Industry insiders pointed out that to solve the problem of building broadband monopoly, real estate, developers and agency operators are the key targets of rectification.

For this reason, the joint rectification action carried out by the five departments including the Ministry of Industry and Information Technology is different from the previous single-functional department’s "single-fighting" pattern. It will give full play to the joint action of multiple departments such as industry and information technology, housing construction, public security, and market supervision to eliminate The monopoly of broadband in commercial buildings has "obstructed" the opening up of the network to speed up and reduce fees.

Specifically, the relevant departments will investigate and rectify three types of violations, namely, exclusive operation of broadband services and restrictive competition in commercial buildings, illegal broadband services in commercial buildings, and non-strict implementation of national standards in newly-built commercial buildings, and targeted artificial manufacturing. Monopoly, high prices, imperfect facilities, and other pain points for commercial broadband acceleration and fee reduction.

The rectification action will be targeted at the above-mentioned problems. The phenomenon of developers building and laying lines not strictly implementing standards, property condoning operators' exclusive operation, and operators' charging high fees are expected to be resolved.

Get through the "obstruction" of speed increase and fee reduction

The use of the smooth and reasonably priced Internet is a "lifeline" for business operations.

Breaking the local monopoly of broadband is of great significance for implementing the reform results of speed-up and fee-cutting and optimizing the business environment.

In recent years, the effect of speeding up and reducing fees for broadband networks in China has been significant.

According to data from the State-owned Assets Supervision and Administration Commission, in 2019, the average tariff of the three major operators will drop by more than 30%, and the fee will be reduced by about 460 billion yuan, optimizing the business environment for market entities.

Liu Liehong, Vice Minister of the Ministry of Industry and Information Technology, pointed out that the joint rectification of the broadband access market for commercial buildings is an important measure to break through the "obstruction" of network speed and fee reduction. It is to do a good job of "six stability", implement the "six guarantees" task, and effectively reduce enterprise production. The urgent need for operating costs.

At present, relevant departments in various places have taken action.

Shanxi Province has established a joint rectification work leadership group, issued a rectification action implementation plan, and started to take action in October; Hubei Province convened four major operators of telecommunications, mobile, China Unicom, and radio and television to carry out work promotion meetings, and carried out preliminary self-examination and rectification; Henan The province has arranged and deployed the joint rectification work, and the basic telecommunications operating companies have begun to promote special rectification work.

In the next step, relevant rectification actions will take the "four steps", divided into four stages: organization and deployment, self-examination and rectification, investigation and rectification, and summary and improvement, and will be carried out in an orderly manner from October 2020 to June 2021.

During this period, the relevant departments will conduct a comprehensive survey of the broadband access market of commercial buildings in the jurisdiction, and urge relevant market entities to conduct self-examination and self-correction around the rectification task requirements and report the implementation of rectification, and pass open and unannounced visits, surprise inspections and random inspections Conduct centralized investigation and remediation of the broadband access market for commercial buildings in the jurisdiction.

"The first is to strive to eliminate exclusive monopolies, to comprehensively investigate and rectify the exclusive operation of broadband business in commercial buildings, and to restrict competition. The second is to resolutely ban high'admission fees', and in-depth investigation and rectification of illegal business broadband services in commercial buildings. The third is to strictly implement the state Standards, continue to investigate and rectify new commercial buildings that do not strictly implement national standards." Liu Liehong said.

It is understood that relevant departments in various regions will adopt list-based management and number-sale supervision on various types of illegal buildings. Violating companies will be publicly exposed by the media and included in the corporate integrity records. The responsible persons of the violating companies will also be included in the list of untrustworthy.

Using violence or threats to force others to accept designated telecommunications business services, or force telecommunications operating companies and their business agents to withdraw from telecommunications business services, in serious circumstances, suspected of forced transaction crimes or other crimes, will be severely cracked down by public security organs in accordance with the law.

"Reducing the average tariffs for enterprise broadband and dedicated lines is conducive to guiding the digital transformation of enterprises, and resolutely rectifying illegal charges will help improve the business environment and further stimulate the vitality of enterprises. This action is timely and important." said Miao Rong, chief researcher of the China Enterprise Confederation .
