The Dubai Dispute Settlement Center, the legal arm of Dubai's Department of Land and Property, said that the tenant is obliged to pay government fees due to Al Ain during the term of the lease, provided that the lease does not provide otherwise.

He explained that these fees are considered as accessories for rent, including fees, taxes and irregularities on the leased premises, stressing that the failure to meet the same consequences of non-payment of rent.

Fees and taxes

In detail, the head of the center, Judge Abdul Qader Musa, said that "the general origin is that the tenant is liable for all fees, taxes and violations due to the use of the property to government agencies and departments, provided that the lease does not contain clauses that violate this."

He added that «if there is no agreement between the parties to the rental equation (landlord and tenant) in this regard contract, so the tenant is bound by, and also applies to the case of sublease».

Moussa explained that «the judges of the center look at the terms of the contract between the owner and the tenant in all its details», pointing out that the tenant and in case of approval of a particular item, in violation of the law, it is bound to sign it.

Tenants were required to include any agreement with the landlord in this regard, under the lease contract, in clear terms.

Moussa pointed out that the existence of clauses concerning how the fees are paid is not a problem as long as the tenant agrees, and it is up to the contracting parties to determine it, stressing that the contract is the law of the contracting parties and that the items for taxes, duties and violations, if any, Other items included in the contract, such as maintenance items, for example, the law provides that the basic maintenance of the owner, unless otherwise agreed.

He said that the center monitors developments in the rental market in the emirate and tries to facilitate all parties to the rental relationship from tenants and lessors, in order to reduce the differences that arise between them.
