A plan to expedite the leasehold registration process will be prepared so that the lessee (tenant) can quickly return the jeonse deposit even if the lessor (landlord) dies.



The Ministry of Justice and the Ministry of Land, Infrastructure and Transport, as well as the government 'Joint TF for Legal Support for Tenants Victims of Charter Fraud', announced that they plan to make a pre-announcement of the amendment to the Housing Lease Protection Act, which allows victims of charter fraud to register their right to lease without prior notice to the landlord.



Tenants who are victims of charter fraud who have purchased charter guarantee insurance from the Housing and Urban Guarantee Corporation (HUG) can claim the return of their deposit.



To do this, you must first apply to the court for an order to register the leasehold and complete the registration.



According to the current law, the landlord must be notified of the decision to order the registration of the leasehold in advance in order to entrust the registration of the leasehold.



As a result, there was a problem that it was difficult to register the lease in time if the inheritance relationship was not arranged after the death of the landlord, as in the recent 'Villa King' case, or if the notice was intentionally avoided.



TF added a provisional provisional foreclosure enforcement even before serving a trial to the debtor in the operation regulations of the leasehold registration order clause of the Housing Lease Protection Act, so that the leasehold registration can be done even before the landlord is notified.



TF previously cooperated with the Supreme Court to simplify the procedure so that tenants can apply for a leasehold registration order with the 'landlord's heir' as the other party without subrogation inheritance registration.



This was also a measure to expedite the return of deposits by guarantee insurance subscribers.



The TF plans to collect opinions from all walks of life during the legislative notice period to finalize the final amendment, and then submit it to the National Assembly next month after review by the Ministry of Government Legislation and vice-ministerial and cabinet meetings.



TF said, "Through system improvement and law revision, the time and cost of the previous lease registration process will be significantly saved, and the burden on tenants will be reduced."
