A man in his 40s who was accused of threatening to kill a resident of the lower house who reported the damage between floors was acquitted in the second trial. 



Today (18th), Daejeon District Court Criminal Appeal Division 1 (Chief Na Kyung-seon) upheld the original verdict of acquittal of Mr. A (44), who was charged with intimidation. 



On October 23, 2020, Mr. A, who lives in an apartment in Sejong City, said that Mr. B (33, female), who lives in the lower house, would kill him by swearing at Mr. B’s couple over the intercom because he habitually reports noise damage. He is accused of threatening, such as going to the front door and shouting at him to come out, saying he would kill him. 



The first trial judge said, "Threat is to notify the other party of harm to the extent of causing fear, but it is difficult to see that the threat was intentional." It appears to have been nothing more than an expression of anger." 



In response, the prosecutor appealed on the grounds of misrecognition of fact and misunderstanding of law, but the same judgment was upheld for the same reason as the lower court in the second trial. 



The 2nd trial court also dismissed it, saying, "It is difficult to say that it has been proven that the defendant announced the harm or that there was an intention regarding intimidation."
