The story of the store owner was told that he was asked to pay for hospital expenses from a passer-by who fell alone in front of a closed store in the early morning hours.

The shop owner A, who wrote the article, expressed his regret and uploaded a CCTV screen containing the accident process intact.   



The accident occurred around 12:20 am on the 1st.

At the time, Mr. A's store was closed because it was closed. 



Mr. B, a woman in her 70s who had an accident, was a customer who came as a family unit to the store next to her, not to Mr. A's store. 



At that time, she and her grandson played a slipping prank on the terrace in front of Mr. A’s store, like ice skating, and it continued for about 7 to 8 minutes and ended only after Mr. B fell over.

Mr. B suffered a fractured shoulder in the accident and underwent surgery. 



The problem is that on the morning of the day after the accident (the 2nd), Mr. B's family contacted the manager and asked the mall and Mr. A's store to take responsibility. 



Mr. B's family, who saw the scene of the accident, said, "The store owner is responsible for not managing the front of the store. Calcium chloride was not sprayed, and up to 1m must be removed based on the store standard. There are many precedents." . 



In response, Mr. A said, “Grandma was aware of the slipperiness and fell over while playing carelessly.” I'm not going," he replied. 



Then, the manager added, "Although calcium chloride was sprayed, slipperiness cannot be completely prevented due to the nature of the season."  



When Mr. A and the manager insisted that they were not responsible, Mr. B said that the problem was that the calcium chloride had not been sprayed continuously, and asked, "Then, the mall and the store have nothing to do with the accident. Are you saying that our fault is 100%?" 



At the same time, he said, "If you say there is no fault unconditionally, you have no choice but to go badly," and even foreshadowed legal action, saying, "I will proceed with the procedure later."



Mr. A said, "I wish her grandmother a speedy recovery. It is very upsetting and heartbreaking that her grandmother was injured, but it is quite unfair and bitter in terms of her responsibility."

A number of fellow self-employed people who saw this said, "It's shameless to show that attitude even though there is evidence video", "The store is closed, the terrace is trespassing, and I fell while playing alone. They all agreed that Mr. A and the mall were not responsible for compensation. 



This is because not only was Mr. B deliberately playing around and falling down recorded on CCTV, but also Mr. A's store was closed and the shopping center managed to respond by spraying calcium chloride.  



Opinions differed, however, on whether this would actually be rewarded. 



One member said, "I had to pay a little bit of alimony because there was no notice or barricade, such as not to go in while I was on vacation," saying that he also received work-related malpractice damages from the court and asked for the results of the civil lawsuit.



Another member said, "Even if I knew it was slippery, if I fell in front of my store, I had to compensate. That's why (I) always sweep the snow every winter."



One member advised, "After examining legal negligence, it may be possible to solve it with fire insurance or business liability insurance purchased in the building."



In fact, in the case of accidents on icy roads, there are precedents in which companies in charge of facility management have been held liable for compensation when they have been negligent in their management duties.
