A high school student who was handed over to trial for allegedly attempting to kill a teacher in his 40s by waking him up while sleeping during class was sent to the juvenile department as a court order in the second trial.



Yesterday (8th), Criminal Divisions 1-3 of the Seoul High Court held a sentencing hearing for Group A (18), who was arrested and charged with charges such as attempted murder, and decided to send him to the juvenile department.



The judge explained the reason for the leniency, saying, "Rather than imposing criminal punishment on the accused, it seems desirable to impose protective measures such as sending him to juvenile detention so that he can grow into a healthy member of society."



He continued, "The first trial decision, which determined that the defendant was intentional in harming and killing, was justified." However, "At the appeal trial, an agreement was reached with two classmates among the victims, and circumstances were changed to appeal for leniency, and there was no criminal record. All factors were taken into account,” he added.



On April 13, at around 10:30 am, at a vocational school located in Namdong-gu, Incheon, Group A attempted to kill teacher B (47) by stabbing him in the chest and other parts, and also injured the hands of two classmates who were stopping him by swinging a weapon. was handed over to trial.



According to the police investigation, when A was pointed out by teacher B while sleeping during class, he went out of school and stole a weapon from a nearby store, and returned to the classroom 20 to 30 minutes later to commit the crime.

During the trial, Group A admitted all the crimes, but said that there was no intent to kill or injure, and insisted that "the angry defendant committed the crime because he could not hold back his anger," but the judge did not accept it.



Previously, in September, the first trial sentenced Group A to a long term of 5 years and a short term of 3 years and 6 months, and ordered 5 years of probation, saying, "We took into account the poor quality of the crime and the situation where there was no agreement with the victim."



Unlike chokbeop juveniles, juveniles between the ages of 14 and 19 can be subject to criminal punishment if they commit a crime.



However, the 2nd trial judge focused on edification and decided on juvenile detention.



Subsequently, the court overturned and dismissed the original court order for probation in the first trial for Mr. A, and also rejected the attachment of electronic devices requested by the prosecution.
