The court has ruled that the unauthorized posting of private information confided by others on the participatory Internet encyclopedia 'Namoo Wiki' constitutes defamation.



According to the legal community on the 28th, Detective 15 of the Seoul Central District Court (Judge Joo Jin-am) sentenced a 20-year-old man to a fine of 3 million won for defamation under the Information and Communications Network Act.



Mr. A is accused of posting his real name and photos by accessing Namoo Wiki on the 17th of February at around 7 am, writing personal information about Mr. B, an internet broadcaster.



Based on what Mr. B said during the Internet broadcast, Mr. A posted on the site, "Broadcaster B dated Mr. C, had sex with several people, and had an abortion."



Prosecutors made a summary indictment with a fine of 3 million won, saying, "Mr. A defamed Mr. B by stating the facts."



Mr. A requested a formal trial, but the court sentenced him to a fine of 3 million won, the same as the prosecution's summary order.



The court said, "It is an advantageous normal that Mr. A is confessing to the crime and Mr. B is writing based on what he said on the Internet broadcast." said.



Meanwhile, publicly disclosing facts through information and communications networks for the purpose of slander may result in imprisonment for up to three years or a fine of up to 30 million won pursuant to Article 70 (1) of the Information and Communications Network Act.
