A man in his 30s who tried to kill his lover with a knife after making a phone call for 10 hours every 2-3 minutes to the lover who announced the breakup was sentenced to prison.
The 14th Criminal Division of the Incheon District Court (Chief Judge Ryu Gyeong-jin) announced on the 27th that it had sentenced A (30), who was charged with attempted murder, trespassing, and violation of the Animal Protection Act, to three years and six months in prison.
Mr. A was indicted on charges of attempting to kill her girlfriend by stabbing her several times with a knife on the stairs of an apartment building in Incheon around 11 pm on the 2nd of June.
On the day of the incident, after receiving the breakup notice from Mr. B, who was in a romantic relationship, Mr. A continued to call every 2 to 3 minutes for 10 hours, and finally went to Mr. B's house.
Mr. A, who sneaked into the house through the terrace, stabbed Mr. B's chest and chin, and threw away Mr. B's dog.
Mr. B took the weapon holding Mr. A and ran away, saving her life, but was diagnosed with a hospital for 4 weeks displaced due to traumatic hemorrhagic shock, etc.
At the time of the prosecution, the prosecution did not apply the charge of violating the Act on the Punishment of Stalking Crimes, etc. to Mr. A, but the court considered it to be a stalking crime and reflected it as a factor aggravating the sentence.
The court said, "When the victim was transported to the hospital, he was bleeding heavily and was in a dangerous state, and he suffered from after-effects such as the severed nerve did not recover. I wore it,” he explained.
"These dating violence crimes are repeated because of the special relationship between the perpetrator and the victim, or because the perpetrator is well aware of the victim's life range and family, it is difficult to report, and the risk of concealment or crime increases." I did.
However, the court said, "The first offender, Mr. A, is reflecting on his crime and it does not appear to be a planned crime." said.
Amendment to the Stalking Crime Punishment Act, the current situation
Earlier, due to the recent stalking murder case at Sindang Station, public opinion about the abolition of the 'non-intentional punishment' clause on stalking crimes is rising.
Non-intentional punishment is a provision that cannot be criminally punished if the victim does not want to be punished. It is also mentioned as a major cause of intimidating or convincing the victim because punishment can be avoided if agreed upon.
In response, the party government announced at the 4th high-level party council meeting on the 25th that "to strengthen punishment for stalking crimes, we will add a bill to amend the stalking punishment law to this year's regular National Assembly's key legislation and promote it quickly."
The amendments include the removal of the anti-indictment penalty for simple stalking crimes, the addition of online stalking to the punishment target, the introduction of a location tracking system to provisional measures applied to stalking offenders (prohibition of access, prohibition of access using telecommunications, etc.) penalties (previously fines for negligence);
