The Court of Appeal has sentenced a Chinese woman who has been illegally staying in Korea for 26 years after marrying a Korean man using a fake ID made in China.



According to the legal community on the 26th, the Seoul Eastern District Court's Criminal Investigation Division 1-2 (Chief Judge Dong-hyeon Kim) was charged with violating the Passport Act, the Immigration Control Act, and misrepresenting the passport. He was also sentenced to 6 months in prison.



In 1996, Mr. A paid 90,000 yuan (currently about 18 million Korean Won) to her broker to earn her money, and created a Chinese identity card in the name of the fictional character 'Ms. Kwon'.



After that, she married a Korean man named B (75) under that name, and Mr. A stayed in Korea and was issued a passport for her.



Between March 2017 and January 2020, Mr. A used her fake passport to enter and exit China four times.



It was because of her, none other than her, Mr. A's embroidery that the unscrupulous behavior of Mr. A, who had been deceiving her own identity for 26 years, was revealed.



As the entry process into China became more stringent due to the COVID-19 outbreak, it became difficult for Korean nationals to enter China.



In response, she pointed out to Mr. A, who was brought to court, that the first trial court "acquired her Korean nationality with her disguised status and abused the legal order regarding her immigration procedures."



He was sentenced to six months in prison, saying, "Considering the fact that he surrendered himself to China due to the stricter entry procedures due to the COVID-19 outbreak, a prison sentence is inevitable."



Mr. A appealed on the grounds that "the sentence was unfair," but the second trial court also said, "The defendant is not guilty of a crime by illegally acquiring Korean nationality and staying in Korea for a long time." There is no change in circumstances that can be taken into account.”
