Earlier, in September 2014, while driving a van near Cheonan IC on the Gyeongbu Expressway, Mr. A collided with a truck parked on the shoulder.
At this time, his wife B (24 years old at the time), 7 months pregnant Cambodian wife, who was in the passenger seat, died in the accident.
However, the prosecution noted that Mr. A had 25 insurance cases with her wife Mr. B as the insured and herself as the beneficiary between 2008 and 2014.
The total amount of insurance money signed was 9.5 billion won, and the sum of delayed interest was over 10 billion won.
Prosecutors also provided evidence that a sleep inducer component was detected in the blood of her wife, Mr. B.
The prosecution judged that A had the intention to kill B and charged A with murder and insurance claim fraud.
However, Mr. A denied the allegations, saying, "I couldn't sleep for more than 21 hours due to work, so I was driving while drowsy and extremely tired."
In 2017, the Supreme Court returned the case to the second trial court with the intent of not guilty, saying that Mr. A's motive for the crime was not clear.
Afterwards, A was acquitted on charges of murder and insurance claim fraud in March of last year, and was sentenced to two years in prison for homicide under the Traffic Accident Handling Special Cases Act.
Meanwhile, this lawsuit, in which Mr. A won against Nonghyup Life Insurance, is the 6th lawsuit against insurance companies for claiming about 9.5 billion won.
We won four lawsuits against Meritz Fire & Marine Insurance, Samsung Life Insurance, and Kyobo Life Insurance, including Nonghyup Life Insurance, and lost two lawsuits against Mirae Asset Life Insurance and Linea Life Insurance.
Mr. A appealed in relation to the two lost cases, and the appeal is currently in progress at the Seoul High Court.
