The 6th Criminal Division of the Busan District Court (Chief Judge Kim Tae-up) sentenced the obstetrics and gynecology nurse A nurse charged with violating the Special Act on the Punishment of Child Abuse Crimes (habitual abuse), etc. sentenced.



In addition, he ordered the completion of an 80-hour child abuse treatment program and restricted employment for seven years at related institutions and facilities.

He also canceled the bail awarded to Mr. A and arrested him in court.



Nursing assistant B, who was also charged with violating the Child Welfare Act, was sentenced to 6 months in prison and 2 years of probation (3 years of employment restriction), and a fine of 30 million won for a hospital doctor.



The court said, "The defendant raised the possibility that the child had a problem before his or her work hours or that an accident could occur due to a cesarean section. You can see it."



He also admitted to the habit of abuse, saying, "If you watch the video, you can see newborns lifting upside down or hitting the buttocks and dropping them on the floor."



The 'A-Young case' refers to the case in which A-Young, who was only 5 days old, showed signs of apnea and fell unconscious on October 20, 2019, in a neonatal room at an obstetrics and gynecology hospital in Dongnae-gu, Busan.



At that time, A-Young's parents filed a complaint with the police saying they suspected abuse in the newborn room, and during the police investigation, A caught the child's foot and shook it upside down.



As a result of the investigation, it was revealed that A had abused 14 newborn babies from October 5, 2019 to the 20th of the same month.



In particular, Mr. A dropped A-Yeong Yang on the floor in an unknown way, injuring her skull and causing cerebral hemorrhage.



Mr. A's side argued that it was possible that the injuries that Ayoung suffered during the initial trial were a birth problem or that she suffered during a cesarean section.



He also stated that he had to work three nights in a row at the time, which was very stressful.

The court said, "As a nurse in the neonatal room, I have a duty to safely take care of a newborn, but neglecting my duty is not justified by my difficult and difficult situation." It caused physical and mental pain,” he said.

Regarding the first trial verdict, Ah-Young's father said, "It is regrettable that the prosecution sentenced me to a shorter sentence than the 7-year sentence requested, but I am glad that the judge recognized the crime and showed strict will."
