The appeal of rapper Noel (22, real name Jang Yong-jun), who was sentenced to one year in prison in the first trial for not complying with a request for a breathalyzer and assaulting a police officer, comes out this week.



According to the court today (17th), the Seoul Central District Court's Criminal Case Division 4-3 (Chief Judge Cha Eun-kyung, Yang Ji-jeong, Jeon Yeon-sook) will hold a trial on the 21st (Thursday) of Jang's case of violation of the Road Traffic Act and obstruction of the execution of official duties.



Prosecutors initially indicted Jang by applying the 'Yun Chang-ho Act', which aggravates repeated drunk driving or refusal to measure alcohol.



However, while the appeal was in progress, the Constitutional Court decided that the Yun Chang-ho Act was unconstitutional, and changed the provisions of the applicable law to violate the General Road Traffic Act.



However, as in the first trial, the prosecution requested the court to sentence Jang to three years in prison.



Jang, the son of Representative Jang Je-won of People's Strength, was driving a car at the intersection of St. Mary's Hospital in Seocho-gu, Seoul around 10:30 pm on September 18 last year, and had an accident with another car. He was arrested on charges of hitting a police officer with the head and was charged with detention in October.



In the first trial, with the exception of the police officer injury, Jang was found guilty of the charges and sentenced to one year in prison.



In 2019, Jang was also charged with driving a car while drunk in Mapo-gu, Seoul, and was sentenced to 1 year and 6 months in prison and 2 years of probation in June 2020.



In his final statement on the last day of his death, Jang said, "I started my social life early and became dependent on alcohol to relieve stress, pain and wounds, and I did things I shouldn't have done. I want to give it to you,” he said.
