A man in his 70s who was handed over to trial for wielding a knife at his wife claimed that "the wife wielded the knife herself" at the appeals court, but the court did not accept this.



According to the legal community today (28th), the 7th Criminal Division of the Seoul High Court (Judge Lee Kyu-hong) overturned the original judgment and sentenced him to 5 years in prison in the appeals trial of Mr. A (74), who was previously sentenced to 7 years in prison for attempted murder.



In August of last year, Mr. A is accused of injuring Mr. B by swinging her weapon in anger while arguing over a drink with her wife B (64).



At that time, Mr. B was stabbed in the face and neck and lost consciousness, and Mr. A thought that Mr. B was dead and reported it to the police, but there was no life-threatening injury.



The court of first instance sentenced A, who had to stand in court because of this, a sentence of 7 years in prison in consideration of the fact that she had received a protective order for domestic violence in the past.



In response, Mr. A appealed on the grounds that his sentence was too heavy.



At the appeals court, Mr. A claimed that Mr. B himself wielded a weapon at the time of the incident, but the court did not accept this.



The court said that Mr. A voluntarily reported to the police immediately after the incident and said, "I stabbed my wife with a knife. It is guaranteed.”

It was also taken into account that A had never made a statement that B had self-harm during the investigation.



However, the court sentenced him to five years in prison, which was reduced from the first trial in consideration of circumstances such as that his wife, B, did not want to punish A.
