A part-time worker at a convenience store who took out products on sale and ate them was acquitted.

This is because the court accepted his claim that he ate the instant food by mistake.



According to the legal community today (16th), the 6th independent criminal judge (Judge Kang Young-jae) of the Seoul Central District Court acquitted A, a woman in her 40s, who was tried for business embezzlement on the 13th.



On the 6th day of working at a convenience store in Gangnam, Seoul, on July 5, 2020, at 11:30 pm, the 5,900 won instant food 'Banban Jokbal Set' was taken out and eaten at 7:40 pm on the same day. I was sued by a convenience store owner.



At that time, the convenience store allowed part-time clerks to eat instant food that had passed the expiration date and was subject to disposal.

Convenience store lunch boxes were disposed of at 7:30 pm every evening, and refrigerated foods were disposed of at 11:30 pm.



It is known that Mr. A mistook the half-and-half pork feet set corresponding to her refrigerated food for a lunch box.

The Banban Jokbal Set had meat, garlic, ssamjang, and vegetables in a disposable plastic container, similar to a convenience store lunch box.



In fact, Mr. A took out the product from the shelf and disposed of it after 10 minutes passed from 7:30 p.m., the lunch box disposal time, and ate it.



During her trial, Mr. A complained of injustice, saying, "She had no intention of embezzlement," she said.



The first trial judged A not guilty of the charges.

The court said, "There is a circumstance that Mr. A thought of the half-and-half set as a lunch box and saw the disposal time as 7:30 pm."



In addition, the court found that Mr. A purchased items exceeding 150,000 won during the 5 days he worked at the convenience store, saying, "If there is an item that he wants to buy at the convenience store, Mr. A, who purchased with his own money, only embezzles a half-and-half set of 5,900 won. It doesn't look like it will," he said.
