According to the legal community today (14th), the 1st Criminal Division of the Gwangju High Court (Judge Lee Seung-cheol) dismissed both the prosecution and the defendant's appeals in the appeals trial against A (69), who was sentenced to four years in prison in the first trial after being charged with attempted murder. A is accused of hitting the back and chest of a neighbor B (71) with a 78 cm long iron pipe in the living room of his home at 7 pm on September 27 last year.



Neighbor B, complaining of pain, fell on his stomach, and Mr. A is also accused of trying to kill B by swinging a knife at Mr. B's buttocks and thighs.



As a result of the investigation, it was revealed that they were playing Go together at the time.

In the meantime, Mr. B won the game, and Mr. A, who was angry with the match, became angry and cursed.



At this, Mr. B said, 'I can't wait for one more game, why are you angry', and Mr. A was enraged at this and committed the crime. 



Mr. A, who was brought to the court, claimed that "there was no intention to kill", but the court of first instance did not accept this.



The first trial judge said, "Mr. A tried to wield a weapon while saying 'I will kill you' to B, who was bleeding. I was able to fully recognize or foresee that there was."



Then, he explained the reason for sentencing, saying, "The guilt of Mr. A is heavy in light of the part where Mr. A showed his will to kill, the part he used to attack Mr. B, the tool he used, and the possibility of death. Severe punishment is necessary."



The court of appeals said, "Mr. A made a statement contrary to the objective facts, saying that he stabbed B with a smaller weapon to the investigation agency even though genetic information was detected in the crime tool."



He continued, "Considering the circumstances before and after the crime, Mr. A's guilt is very heavy," he said.
