The court acquitted the 40-year-old man who was handed over to the trial on charges of refusing to be a prosecutor while hiding his attendance at the Gwanghwamun rally from the quarantine authorities.



According to the legal community today (9th), Detective A (49), who was charged with violating the Act on the Prevention and Management of Infectious Diseases, was acquitted of Detective 7 (Judge Lee Ji-hee) of the Changwon District Court.



Previously, the city of Changwon filed a complaint against A on the grounds that he had confused the quarantine by hiding this fact even after attending the 8/15 Gwanghwamun rally held at Gwanghwamun Square in Jongno-gu, Seoul on August 15, 2020.



After the Gwanghwamun rally attended by a large number of people at the time, on August 17, 2020, the Gyeongsangnam-do quarantine authorities issued an emergency administrative order requiring all participants of the Gwanghwamun rally to undergo a corona test.



Changwon Public Health Center made a phone call to encourage A to confirm the movement and to conduct a diagnostic test, but Mr. A did not take the test, saying, "I did not attend the Gwanghwamun assembly." After that, Mr. A showed symptoms of Corona 19 and was positive for Corona 19 on the 27th of the same month. I have been judged.



In this regard, the city of Changwon said, "Mr. A, while attending the Gwanghwamun rally, hid the facts and refused to be tested, thereby spreading the infection in the area." I filed a claim for reimbursement.



However, the court judged, "There is not enough evidence to prove that Mr. A lied that he did not visit the Gwanghwamun rally."



The court said, "Mr. A consistently stated that 'I attended other gatherings nearby, not Gwanghwamun,' from before the indictment of the case to the courthouse. It is not enough to believe that Mr. A's statement that 'I did not attend the Gwanghwamun rally' was false based on the evidence presented alone."



He added, "As long as Mr. A stated at the time of the epidemiological investigation that he 'visited Gwanghwamun by bus with the attendees of the Gwanghwamun assembly, and watched the Gwanghwamun assembly nearby,' it is difficult to evaluate that he made a false statement in the epidemiological investigation." The prosecution in this case is for a time when there is no proof of the crime, so the verdict is not guilty."



The legal community predicted that the results of this criminal trial will affect the future civil lawsuits against Mr. A for indemnity.
