A 60-year-old man accused of killing his disabled older brother while arguing over a drinking problem has also been sentenced to 18 years in prison.

Today (29th), Seoul High Court Criminal Division 7 (Chief Judge Lee Kyu-hong) sentenced A (61), who was charged with murder, to 18 years in prison as in the first trial.

Mr. A was put on trial for the murder of his brother B with a knife in an apartment in Gangseo-gu, Seoul last June.

The brothers often quarreled over drinking problems, but on the day of the incident, at 1:30 pm, while drinking, Mr. B rebuked Mr. B, saying, “Are you drinking again?” This led to a fight and then a fight.

Enraged at this, Mr. A swung a knife at his brother B several times, and it was confirmed that he called after more than 3 hours at 5 pm.

Before the report, it was found that he went out to buy alcohol and blocked the entry of the nursing care worker who received the call from Mr. B.

B, a disabled person with limited mobility, was transported to the hospital, but eventually died.

Person A, who was sentenced to prison in the first trial, appealed, saying, "I had no motive to kill my brother, who was disabled, and I had no memory of being drunk."

However, the Court of Appeal did not accept this.

The Court of Appeal pointed out, "There is no mistake in the fact that the victim changed clothes and went out to buy alcohol or blocked the entrance of the nursing home even though the victim was lying down."

"It takes into account that the crime does not appear to be planned and his health is very poor, but considering the fact that he was able to save the victim but did not do so, the sentence of the lower court does not appear to be unfair," he said.
