A wife who strangled her husband to death has been commuted on appeal.

This is because the court of appeals judged that the sentence of the lower court was heavy for this woman who had suffered from domestic violence for decades.



According to the legal community on the 21st, the Seoul High Court Criminal Division 6-1 (Judge Won Jong-chan) overturned the original sentence of 12 years in prison for A (60) charged with murder and sentenced him to 8 years in prison.



Mr. A was brought to trial on May 29 last year for the murder of her husband B (then 66).



On the day of the incident, Mr. A was angry that his husband, Mr. B, suspected of having an affair and threatened, "I will kill your mother and brother."

At the first trial held as a public participation trial, the court explained, "Mr. B was usually taking medication for angina, and it seems that he was intoxicated on the day of the incident and had limited movements."



He also sentenced A to 12 years in prison, saying, "It must have been a considerable amount of pain as I gradually stopped breathing by my spouse, whom I had been living with for 40 years."



However, the second trial court overturned the original judgment and sentenced A to 8 years in prison.



The second trial judge said, "It seems that A suffered from habitual verbal abuse and assault by her husband B during her long married life. If the statements of the son and others are consistent, and they do not have direct experience, they cannot be made up and stated.”



He continued, "My son was also frequently assaulted by husband B, and on the day of the incident, Mr. A took into account the fact that he was assaulted and verbally abused by husband B for the same purpose, and it appears that he committed the crime by accident." said.
