A court has sentenced a subcontractor representative to murdering a subcontractor employee because he thought he was deliberately not giving a job.



Today (8th), the 3rd division of the Supreme Court (Chief Judge Ahn Cheol-sang) confirmed the original trial sentence of 28 years in prison for A (55), who was charged with murder.



In April last year, Mr. A was indicted on the charge of stabbing an employee of a subcontractor B after leaving a company in Ulju-gun, Ulsan, and stabbing him several times with a knife.



At that time, Mr. A smiled at Mr. B, who was leaving work, and said, "I have come to give you a briefcase."



Mr. A, the representative of a subcontractor, received a subcontract from Mr. B, an employee of a subcontractor in 2019, and has been working for over a year. 

The first trial court sentenced A to 30 years in prison.



The court of first instance sentenced him to 30 years in prison and said, "When Mr. B was on his way home from work, he died at the young age of 38 without knowing why he had to die." It is difficult to imagine the horror and pain that Mr. B must have felt.”



He then explained the reason for the sentencing, saying, "It is questionable whether the accused truly reflects on the crime." 



However, in the second trial that followed, the second trial court commuted the sentence of Mr. A to 28 years in prison.



The reason was that Mr. A, who claimed that it was an 'accidental crime' in the first trial, changed his attitude in the second trial, admitted that it was a planned crime, and reflected on it. 



The second trial court said, "Mr. A denied the plan of the crime in the first instance, but admitted that it was a planned crime in the second instance and stated that she was reflecting on her mistake. It is judged that the sentence of the centrifugal court is too heavy.” 



Person A appealed, saying that the sentence of the second trial was heavy, but the Supreme Court dismissed it and maintained the judgment of the second trial, saying, "Even taking into account the circumstances of the appeal, the sentence of 28 years in prison cannot be said to be very unfair."
