An elderly woman in her 70s who confessed to murdering a son in his 50s, but was acquitted in the first trial, escaped punishment in the second trial.

Seoul High Court Criminal Division 1-2 (Chief Judge Eom Sang-pil Shimdam Lee Seung-ryun) maintained the first trial judgment of acquitting A (78), who was charged with murder on the 1st.

The court said, "Among the questions raised by the original court, there are still unresolved questions." "It is difficult to rule out doubts as to whether it is true that there were only the accused and the victim at the time of the crime, and that the specific crime, such as the indictment, was realized." .

The court pointed out that neither the statements of the other family members who were at the house until immediately before the incident nor the confessions of Mr. A were credible.

The reason was also cited as the reason that the room was cleaned very well immediately after the crime and that the behavior of other family members was different from usual immediately after the crime.

The court concluded, "The conclusion of the judgment may be strange to the defendant. The defendant may be the only person who knows the truth about what happened that day," and concluded as in the first instance not guilty.

A was arrested and charged with killing his son B (52) by strangling him with a towel after hitting the head of his son B (52) at his home in Michuhol-gu, Incheon in April 2020.

At the time, Mr. A directly reported to 112, saying, "I strangled my son" right after the incident, and was arrested as a current criminal by the police.

Mr. A consistently stated that he committed the crime because his son was pitiful even in court.

However, while Mr. A is an elderly woman, his son B is a strong man who is 173.5 cm tall and weighs 102 kg. gave birth

The first trial court found that it was possible that a third party was at the scene and that Mr. A may have made false statements to protect her other family members, and she acquitted her.
