The court dismissed a lawsuit against a disciplinary action filed by an army captain for making blasphemy remarks to a junior executive.



The disciplinary action given to the captain of the army by that unit was considered justifiable.



According to the legal circle today (21st), the 1st administrative division of the Chuncheon District Court (Chief Judge Yoon Jeong-in) dismissed Mr. A's request in an administrative lawsuit filed by Captain A of the army unit, saying, "The disciplinary action is unreasonable."



Previously, Mr. A was disciplined for swearing at Mr. B, a beginner, who transferred to his unit.



Each time Mr. A meets Mr. B because he has an introverted personality, he says, "Why are you living like this?" and demeans his appearance, saying that he resembles a monster from a cartoon and "I think he'll run away because he's scared at night." made a statement.



Also, in the presence of other soldiers and officers, he held and dragged Mr. B's belt and wrist, and treated Mr. B with humiliation. 



Unbearable Mr. B asked, "Please refrain from using insulting words," but Mr. A did not give in and showed no remorse, boasting about the fact that he inflicted verbal violence on Mr. B to other executives. 

In the end, Mr. B, who could not stand the harassment of Mr. A, confessed his grievances to the unit, and the unit fired Mr.



However, Mr. A was dissatisfied with the disciplinary action and filed an administrative lawsuit with the court. 



In the courtroom, Mr. A insisted that the remarks he made to Mr. B were not verbal abuse, saying that it was an expression that could be tolerated in terms of social norms among acquaintances.



The court said, "At the time, Mr. A was appointed as a counselor of the same age and had a duty to listen to the grievances of junior executives, but he repeatedly made insulting remarks and made him feel sexual shame." It is much larger than the limited private interests of the plaintiff," and dismissed Mr. A's claim.



Meanwhile, Mr. A previously filed an appeal with the Military Appeals Review Committee and the Disciplinary Appeal Review Committee regarding the disciplinary action, but they were rejected one after another.
