The petitioner, who sent a contemptuous text message to colleagues, filed a lawsuit against the dismissal and lost.



The second administrative division of the Seoul Administrative Court ruled in favor of the plaintiff in a lawsuit against the head of a local government for cancellation of dismissal by a former petitioner police officer A.



Mr. A was reported as 'workplace harassment' by three new hires in 2019, and was dismissed in September of the following year.



Mr. A sent emails and text messages to one of his junior petitioning police officers stating that he 'appears to be doing a show alone' and 'it appears to be not in normal condition, such as pretending to be mentally ill.'



While arguing over vacation use with another junior petitioning police officer, who was a woman, she noted that she was 'going to vomit when I see her face.'



Dissatisfied with the dismissal, Mr. A filed an administrative litigation, stating, "According to social norms, it was an expression of opinion that could be sufficiently expressed between co-workers or a conflict of emotions, and it was not an act of intentionally harassing."



However, the court ruled that "it is recognized that the plaintiff has committed an act of disrespect that damages the dignity of the victims by harassing them in the workplace."



Person A did not appeal, and this judgment was confirmed as it is.
