If the quarantine pass was applied or stopped, the citizens would be most confused and uncomfortable. The court rulings are also mixed, so it seems that confusion will continue for the time being.

Yesterday (14th), when the decision to suspend quarantine passes for marts and department stores in Seoul was announced, another court of the same court made the opposite decision.



He rejected the application for suspension of execution against the Minister of Health and Welfare to suspend the quarantine pass for large marts nationwide.



For the same hypermarket, one court saw that it was necessary for everyday life and that the risk of transmission was low, while the other judged that there is no problem because there is an alternative means such as a traditional market.



There is no clear basis or standard to determine the effectiveness of the quarantine pass in the unprecedented Corona 19 situation, so each court is different.



Judgments are inconsistent even with regard to the type of facility and age, but each court has different interpretations of whether the Minister of Health and Welfare or the head of a local government has the right to take administrative measures, so the areas of application are also different.



There are currently six administrative lawsuits over the quarantine pass, including two cases in which the decision to suspend execution has already been issued.



There is a possibility that court battles will eventually be decided by the Supreme Court, but there is also a forecast that it is difficult to expect specific and consistent standards to come out in a situation where quarantine policies change frequently.



The Constitutional Court's decision on whether the quarantine pass is unconstitutional also remained a variable.



This is the reason why some have pointed out that the government should focus on preparing more sophisticated countermeasures, rather than relying on the judgment of the courts, while the confusion is on the citizens during the lengthy and complicated process.
