According to the legal community on the 5th, the Seoul High Court's Criminal Division 1-2 (Chief Judge Eom Sang-pil Shimdam Lee Seung-ryun) was recently handed over to 17-year-old Miss A, who was handed over to trial on 16 charges, including retaliatory injury under the Aggravated Punishment Act for Specific Crimes and coercion under the Child and Juvenile Sexuality Protection Act. He was sentenced to a long term of 4 years to a short term of 3 years in prison, and was also ordered to complete an 80-hour prostitution prevention program.
In the first trial, Miss A was sentenced to a long term of 1 year and 6 months to a short period of 1 year on charges of retaliatory injury, etc. As a result of this merger, the sentence was slightly reduced.
According to the Juvenile Act, a minor under the age of 19 who commits a crime can be sentenced to indefinite sentences with upper and lower limits for both long-term and short-term sentences.
From November 2019 to April last year, Ms. A was handed over to trial on charges of hitting or choking five younger female students several times in a parking lot in Incheon, etc., and filming and sharing the scene.
In the process, it was investigated that when a victim complained, he went to visit him saying "I apologize" and assaulted him again and kicked him in the face.
Miss A is also accused of forcing other victim students into prostitution, taking the price, and hitting or imprisoning the victim in a closet when the victim did not listen to her.
In an attempt to steal wealth by threatening a man who lured him under the guise of a conditional meeting with a friend, he failed.
The court of first instance found guilty of most of the charges and sentenced them to imprisonment, and this judgment was maintained on appeal.
The court of appeals said, "(The act of coercing prostitution) not only inflicts indelible physical and mental pain on victims, but also harms a sound sexual culture and good customs, which is very illegal and highly accusable." I have not been forgiven, and the damage has not been properly recovered.”
However, it added that "there is still a lot of possibility that the accused will establish the right values and return as a healthy member of society through serious reflection and appropriate reformation in the future."
