Justice rejected this Tuesday in Toulouse for the third time a request for the release of the husband of Delphine Jubillar, who still claims his innocence and must be heard by the investigating judges on the disappearance of his wife in December in the Tarn .

"We are not completely surprised even if we do not have the motivation. But the chamber will tell us to wait for the hearing in mid-October", declared Me Alexandre Martin at the exit of the hearing, without giving more details on the date of this first hearing on the merits of Cédric Jubillar.

This 34-year-old drywall painter was indicted for murder and imprisoned on June 18.

"No proof" of his guilt

On July 8, the investigative chamber of the Toulouse Court of Appeal first rejected a request for release, then on September 2 the liberties and detention judge took a similar decision. For several months, lawyers for the nurse's husband have been protesting against this detention, stressing that there is in this file "no proof" of the guilt of their client.

"The isolation has been renewed for 3 months by the director of the remand center because they do not have the possibility of carrying out an individual cell", underlined Me Emmanuelle Franck, one of the three lawyers of Cédric Jubillar .

For his part, Me Laurent de Caunes, the nurse's family lawyer, believes that the continued detention "is quite normal in the context of this procedure" emphasizing "(that) everything must be done to preserve the investigation and the instruction ".

The body of the 33-year-old nurse, who lived in the village of Cagnac-les-Mines (Tarn) with her husband and their two children, has not been found.

The couple were going through a divorce.
