In June 2018, Mr. B issued a promissory note with a face value of KRW 100 million and a payment due date of October 31, 2018 to Mr. A and prepared a notarized promissory note.



A month after the bill was issued, Mr. A wrote a memorandum under the condition that 'Mr. B will live together until the age of 90'.

It is said that the memorandum contains contents such as 'do not ask for more than 100 million won', 'you cannot share affection with other men', 'do not assault', and 'as long as they live together'.



However, Mr. B's promise to pay 100 million won was not kept. Accordingly, on November 8, 2018, Mr. A applied for a compulsory auction of land owned by Mr. B in Goyang-si, Gyeonggi-do, and received a decision to start the next day, using the notary of promissory note as the executive right. Mr. B filed an objection to the claim against Mr. A to the effect that the promissory note was null and void because it was predicated on a memorandum.

Mr. A had Mr. B come to his house to record content favorable to the proceedings. On the night of November 27, 2018, Mr. B visited Mr. A's house and requested to cancel the forced auction procedure. When Mr. A did not accept this, the two had a big argument.



The next day, when drunk B asked again to cancel the forced auction procedure, A hit B's head against the door frame several times and left B's unconscious face covered with a blanket, leading to death. known.



The court said, "The brutality of violence against an elderly victim who had been dating for many years resulted in a serious and irreversible result of death. He was seriously injured, and Mr. A denied the crime and made no effort to recover the damage."
