A teacher who became controversial by giving his elementary school students washing underwear as homework and posting sexually inappropriate comments on class SNS has been sentenced to probation in a public participation trial.



On the 21st, the 12th Criminal Division of the Ulsan District Court (Chief Judge Hwang Un-seo) announced that elementary school teacher A, who was handed over to trial for violating the Act on Punishment of Child Abuse Crimes, was sentenced to one year in prison and three years of probation.



At the same time, the court sentenced A to 40 hours of lectures on sexual violence treatment and 5 years of restrictions on employment at child and youth-related facilities.



In April last year, Mr. A gave his first graders of elementary school the homework 'Sucking his underwear' and asked them to upload their certified photos on the class SNS, and then wrote 'Beautiful underwear (?) shy', 'My princess pink underwear is pretty', ' My princess has been charged with posting comments such as 'Clear shyly'.




Mr. A was also charged with violating the Privacy Act by uploading photos of the underwear laundry showing the students' faces as they are, or scenes of sports sessions, etc., on his YouTube channel without parental consent.



This behavior of Mr. A became known when a parent posted on a portal site bulletin board with the title, "Is it normal for a first-year teacher in elementary school", "There are a lot of strange things, but no one raises a problem" along with a photo captured on SNS. .



As the controversy grew at that time, Mr. A said, "It was a mistake to give this assignment while there was little communication with the parents." He said, "I usually don't comment on pictures of children, but I think that school starts online and the children will have a strong desire to come to school. I commented on each photo on the ."



However, after that, a petition for the removal of Mr. A was posted on the bulletin board of the Blue House, and the petition was approved by more than 200,000 people.




In response, Blue House Education Secretary Park Kyung-mi replied, "After the Ulsan Office of Education became aware of the matter, the teacher was excluded from the class and requested the police to investigate." Mr. A was actually fired in May last year.



Meanwhile, in this trial, the issue was whether the 'washing underwear' homework was abuse. Among the parents who came out as witnesses, there were mixed testimonies that the children perceived homework as play and the testimony that they had no choice but to do it because they were worried about disadvantages.



One parent claimed, "Mr. A explained the concept of a filial piety task in advance, and the children also recognized the homework as a concept of play." I did,” he objected.



Prosecutors decided that A was intentional in continuing inappropriate behavior even though parents, fellow teachers, and pupils raised the issue several times, and requested three years in prison for A.



The jury unanimously found Mr. A guilty. According to the sentencing opinion, 5 people were sentenced to 1 year in prison and 3 years of probation, and 2 people were sentenced to 2 years in prison and 3 years of probation. In this trial, if a sentence of more than the suspended sentence of imprisonment is confirmed as the first trial, Mr. A will not be able to reinstate in effect.
