Dongsan High School in Ansan, Gyeonggi Province, won the lawsuit against the cancellation of the designation of an autonomous criminal high school.



As a result, the education authorities have recorded a total defeat in 10 private high schools and lawsuits in Seoul, Busan, and Gyeonggi Province since 2019.



The 4th administrative division of the Suwon District Court (Chief Judge Song Seung-woo) announced today (8th) that in a lawsuit filed by the school corporation Dongsan Academy against the Gyeonggi Superintendent of Education to cancel the designation cancellation of the self-high school designation, "I am canceling the disposition of canceling the self-high school in Ansan Dongsan High School.



The court said, "The designation and cancellation of the private high school adopts a renewal system every five years." "The plaintiff was designated as a private high school in 2009 and maintained its status in 2014, and the review conducted five years later in 2019 became a problem in this case. "He said.



He continued, "There were many changes to the review standards in 2014 and 2019, and the (defendant) had to notify the plaintiff of this before the review target period, but only changed the review standards and notified them about the end of the target period." pointed out.



The court ruled that "the defendant's cancellation of the designation of the private high school was contrary to the legislative purpose of the system for prior disclosure of disposition standards, and deviated and abused its discretion against the nature of the renewal system and the request for a fair review derived from the principle of due process."



As a result, Ansan Dongsan High School maintained its status as its own high school.



Ansan Dongsan High School is 62. It is about 8 points less than the 70 points for redesignation of self-high schools in June 2019 I received a score of 06 and received a notice of cancellation of the designation from the Gyeonggi Office of Education.



At the same time, Busan Haeundae High School and 8 private high schools in Seoul (Kyunghee, Baeje, Sehwa, Soongmun, Shinil, JoongAng, Ewha Womans University, and Handaebu High School) were also cancelled.



In response, 10 private high schools including Ansan Dongsan High School did not properly guide the evaluation index even after the Office of Education changed the evaluation index in advance, and at the time of evaluation, the new evaluation index was made unfavorable to the school and the evaluation itself was unfair. An administrative lawsuit was filed.



Starting with Haeundae High School in Busan in December of last year, the court granted the hands of 8 private high schools in Seoul this year, and today, Ansan Dongsan High School also won a ruling, and each office of education lost all litigation related to private high schools.



All applications for injunction filed by these high schools prior to the main lawsuit have also been cited.



“I hope the Gyeonggi Provincial Office of Education humbly accepts this result and does not raise any further issues,” said Jo Gyu-cheol, the principal of Ansan Dongsan High School.



The Gyeonggi Provincial Office of Education will announce its position on the outcome of the trial at a later date.



Both the Busan Office of Education and the Seoul Office of Education, which lost earlier, appealed.
