A 50-year-old man who was handed over to trial on the charge of attempting to sexually assault an acquaintance he had known before was struck by his fist and passed out, was also sentenced to prison in the appeals court.



The Seoul High Court Criminal Division 11-1 (High Court Judges Hyun-woo Lee, Ui-dong Hwang, Seung-tae Hwang) announced on the 3rd that the 52-year-old A, who was charged with rape and injury, was sentenced to three years in prison as in the first trial.



Person A is accused of sexually assaulting her while drinking alcohol at the residence of her acquaintance B in October 2019.

Person A dragged Person B into the room and struck her on the forehead and face several times with her fist, saying, "Stand still." In the process, it was investigated that Mr. B stopped the crime when Mr. B passed out.




Immediately after the incident, Mr. B reported sexual assault and asked for help from his sister and acquaintances.

It is known that B was diagnosed with 3 weeks of dislocation due to A's assault.



During the trial, Mr. A denied the allegation of sexual assault, saying, "I had a good relationship with Mr. B."

Regarding the assault allegation, he claimed, "Mr. B's dog bit me, and Mr. B was beaten in the process of refusing it."



The first trial judge concluded, "When the police who received the report arrived at the scene, Mr. B had a bruise on his forehead and blood under his lip. The fact that Mr. A hit Mr. B is acknowledged."

In addition, he was sentenced to three years in prison, saying, "I cannot accept Mr. A's claim, given the victim's response immediately after the incident."




The second trial also found that "The victim's statement is specific and consistent in the main part, so it does not appear that Mr. B falsely or exaggerated the fact of the damage."

He also pointed out that "A is stating that he hit Mr. B on the forehead in the process of being bitten by a dog, but there is no story about a dog in the records when the police were dispatched."



The judge continued, "Looking at the details of the crime, the case is not light, and the victim is complaining not only of physical pain but also of mental pain. However, Mr. A denied the crime, did not reflect, and was not forgiven by Mr. kept as it is.
